Roblox and Discord are trying to push bellwether claims in a child sexual exploitation MDL out of court and into arbitration.

Their argument: the federal law protecting sexual-assault plaintiffs from forced arbitration doesn’t apply when the platforms are accused of enabling abuse by third parties, rather than committing the abuse themselves.

That distinction could matter well beyond this case.

If the court accepts it, defendants in platform-based abuse cases may have a much stronger path back to arbitration.
