Uber accused a Philadelphia PI firm of helping inflate injury claims through coordinated medical treatment and allegedly fraudulent settlements.
Now the firm says Uber’s own discovery may have blown up the case.
Simon & Simon is asking a federal judge to dismiss the RICO claims, arguing that evidence produced in discovery shows Uber wasn’t actually damaged by the settlement payments it is suing over.
The bigger issue is interesting:
When carriers and defendants turn ordinary injury litigation into a RICO case, proving actual injury to the defendant can become the whole ballgame.
